The case in Fully Profit (Asia) Ltd v Secretary for Justice [2012] CACV 87/2011 in the Court of Appeal of the High Court of the Hong Kong Special Administrative Region concerned the meaning of “house (屋宇)”.

確定及測量土地的位置

香港特別行政區基本法第7條說明，香港特別行政區境內的土地和自然資源屬於國家所有，由香港特別行政區政府負責管理、使用、開發、出租或批給個人、法人或團體使用或開發，其收入全歸香港特別行政區政府支配。政府出售土地的基本政策，是在公開拍賣中，把租契售與出價最高者；政府亦可以私人協約方式批租土地。

因此，香港特別行政區的私有土地，除聖約翰座堂外，一律是租賃土地。土地測量師的其中一項工作，是確定及測量從前批出租賃土地的位置。
